The International Register of Losses for Ukraine has opened the possibility of submitting applications in a new category aimed at protecting the interests of legal entities and businesses: Category C3.2 - Loss of control over property in temporarily occupied territories .
Applications in category C3.2 can be submitted by legal entities of any form of ownership (private companies, as well as state and municipal enterprises):
- who are owners of property (and in the case of legal entities of the state and municipal sectors - who have the right of economic management, operational management or usufruct over the relevant property in accordance with the legislation of Ukraine) located in the temporarily occupied territory of Ukraine;
- who lost control over such property due to the aggression of the Russian Federation.
"Loss of control over property in temporarily occupied territories" means the deprivation of a legal entity of the ability to fully or substantially own, use, or dispose of its assets without dependence on the aggressor state, its occupying authorities, military structures, or any organizations under their control.
Within category C3.2, claims are accepted for the value of property over which control has been lost; loss of profit (lost profit) due to the inability to use the property; and total loss of business.
Applicants must provide documents confirming the property rights to the assets, their location, the circumstances of the loss of control, as well as a detailed assessment of the losses with the calculation methodology. In the case of declaring claims for loss of profit, it is necessary to attach commercial and financial statements for the periods preceding the loss of control, as well as a calculation of the costs that the enterprise would have incurred to obtain the relevant income.
All submitted applications that meet the established requirements are entered into the Register by decision of the Register Council. They will then be submitted for consideration by the future international Compensation Commission, to be established under the auspices of the Council of Europe, which will directly assess the amount of damages and decide on the amount of compensation to be paid.
To date, the Convention on the Establishment of an International Compensation Commission for Ukraine has been signed by 39 states and the European Union.
The launch of category C3.2 is another practical step in implementing the Register's mandate to record losses incurred by businesses as a result of the full-scale invasion and temporary occupation of the territories of Ukraine by the Russian Federation.
